Penalty Terms
In the case of the renter returning the car late:
The first hour is free.
For 2-6 hours, a fee of 100 baht per hour is applied.
For 6-12 hours, half the daily rental rate is charged.
For over 12 hours, the full daily rental rate is charged.
Free delivery within the Mueang district (8:00 AM – 8:00 PM). For delivery outside of business hours, an additional fee of 200 baht will be charged.
For gasoline engines, the renter must use Gasohol 91 or Gasohol 95 only.
If the renter wants to extend the rental period beyond the duration specified in the rental contract, the renter must notify the lessor in advance. The service fee will be calculated based on the original rental rate in the contract. The rental extension must receive prior approval from the lessor each time. (The company reserves the right to deny the extension if the vehicle is not available for continued rental.)
The car rental insurance throughout the rental period under this contract is Type 1. In the event of an accident where there is an involved counterpart and the renter is not at fault, the renter incurs no expenses.
To ensure the renter’s involvement in cautious use of the rental car, in cases where the renter is at fault or there is no involved counterpart (e.g., hitting trees, utility poles, scraped while parked, broken or cracked windows, etc.), the renter must pay initial liability costs (1,000 – 5,000 baht) and costs for loss of benefits as stipulated in the contract.
The initial liability costs, in cases where the renter is at fault or there is no involved counterpart in an accident, include claim opening costs of 3,000 baht and initial repair costs starting from 1,000 – 5,000 baht per spot. Additionally, in cases where the car is parked for repair, the renter agrees to compensate the lessor for loss of benefits at a rate equivalent to the daily rental price until the car is fully repaired, but not exceeding 50,000 baht. The lessor will initially collect the damage costs from the renter and provide repair receipts to the renter. If the costs exceed the initial payment, the renter agrees to pay the additional amount. If the initial payment is more than the actual repair costs, the lessor will refund the excess amount to the renter within 3 days of the vehicle repair completion date.
If the renter refuses to pay for damages on the vehicle return date, the renter agrees to allow the lessor to pursue recovery of repair costs, loss of benefits, and tracking expenses as an alternative.
The renter shall maintain the rented vehicle in good condition, as a reasonable person would care for their own property. In the event of any abnormal occurrence with the vehicle, the renter must promptly notify the lessor. The renter agrees to accept responsibility for any damage caused directly or indirectly by the renter, according to the company’s terms and conditions. The rented vehicle must only be used within the agreed location, which is Chiang Mai province.
Driver Requirements: Only licensed drivers are permitted to operate the rental vehicle.
Traffic Regulations: For the safety of the renter, the renter agrees not to exceed the legal speed limits and to strictly adhere to traffic regulations.
In the event of exceeding the speed limit of 120 km/h more than three times, the fuel system will be disabled. The lessor has the right to terminate the contract and withhold any refund of rental fees in all such cases.
In the event that traffic officers or authorized personnel issue a traffic citation or report an offense resulting in a fine, regardless of when it occurred during the rental period, the renter shall be solely responsible for paying all associated fines incurred. The company will notify the renter accordingly.
Equipment and Spare Parts of the Vehicle: The renter is responsible for maintaining and using all equipment and spare parts of the vehicle carefully. In case of damage or loss, the renter must pay at the respective product’s price.
No Smoking: Smoking inside the vehicle is strictly prohibited. Violation will result in a charge of 3,000 Baht for odor removal, carpet, and upholstery cleaning.
Prohibited Uses: Renters are not permitted to pawn, sell, or use the vehicle for illegal activities such as driving under the influence, transporting illegal goods or persons. Any such actions allow the company to immediately terminate the rental agreement, suspend fuel supply to the vehicle, and return the vehicle along with withholding the rental fee and security deposit.
Asphalt (Tar) Stains: Renters must avoid driving over asphalt or embedded asphalt stains at high speeds. If asphalt stains or embedded asphalt stains are found on the rented vehicle, an additional cleaning fee of 1,500 Baht per occurrence will apply in all cases.
In case the renter violates any terms of rental agreement, the lessor has the right to immediately terminate the rental agreement and may retrieve the vehicle along with withholding the rental fee and security deposit.
If the renter fails to comply with any term of the rental agreement for any reason whatsoever, resulting in damages to the lessor, the renter agrees to pay the lessor for such damages within 30 (thirty) days from the date of receipt of the notification letter. If the renter fails to comply, the renter agrees to allow the lessor to claim compensation for damages and collection costs.
